Terms of Use

1. Eligibility

You must be at least 13 years old to use Captory. By using the Service, you confirm that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

Captory is an intelligent inventory application that lets you create, organize, and manage inventories of physical objects using photos, AI detection (InstaScan), barcode scanning, voice notes, and manual entry.

The Service is offered in a free tier and paid subscription plans. We reserve the right to modify, add, or remove features at any time with reasonable notice.

3. User Account

• You are responsible for maintaining the confidentiality of your credentials.
• Do not share your account with others or allow unauthorized access.
• You must provide accurate and up-to-date information when registering.
• You are responsible for all activity that occurs under your account.
• You may delete your account at any time from Settings › Delete account.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Upload content that infringes third-party intellectual property rights.
• Attempt to access, probe, or compromise our systems without authorization.
• Resell, sublicense, or redistribute the Service or any part of it.
• Use automated tools (bots, scrapers) to extract data from the Service.
• Upload content that is harmful, abusive, defamatory, or obscene.
• Impersonate another person or entity.

5. Content Responsibility, Prohibited Conduct & Indemnification

You are solely responsible for all content you upload, capture, process, or store in Captory, and you represent and warrant that you hold all rights necessary to use it. You agree not to use the Service to create, upload, store, or process content that: (a) is illegal or promotes illegal activities; (b) infringes the intellectual property, privacy, or other rights of third parties; or (c) violates the usage policies of our providers, including OpenAI, Apple, and Google.

You are strictly prohibited from using the Service to produce, upload, store, distribute, or process child sexual abuse material (CSAM) or any content that sexualizes minors. Any such content will be reported immediately to the National Center for Missing & Exploited Children (NCMEC) and/or the competent authorities, and records will be preserved as required by law.

We may immediately suspend or delete, without notice or refund, any account that violates these rules. You further agree to indemnify and hold harmless Captory App, its officers, employees, and providers from any claim, damage, loss, or expense (including reasonable legal fees) arising from content you upload or from your use of the Service in violation of these Terms.

6. Subscriptions and Payments

Captory offers the following plans: Free, Mudanza Express, Personal Pro, Propiedades, and Business. Paid subscriptions are billed periodically according to the plan selected.

• Payments are processed by Apple App Store, Google Play, or RevenueCat depending on your platform.
• Subscriptions renew automatically unless cancelled before the renewal date.
• Mudanza Express is a one-time purchase granting 30 days of access from purchase and does not auto-renew.
• To cancel, manage your subscription from your App Store or Google Play account settings.
• Refunds are subject to Apple's or Google's policy, as applicable.
• We reserve the right to change prices with prior notice. Active subscriptions are not affected until renewal.
• Downgrading or cancelling a plan takes effect at the end of the current billing period.
• The Business plan is billed directly outside the stores; contact us to activate it.

7. Your Content

You retain ownership of all content you create in Captory — inventories, photos, notes, and data. By using the Service, you grant Captory App a limited, non-exclusive license to store, process, and display your content solely to provide and improve the Service.

We do not sell your content to third parties. Your content is processed by our infrastructure and AI providers strictly to deliver the features you use. See our Privacy Policy for details.

8. AI Features (InstaScan)

InstaScan uses OpenAI's vision models to detect and describe objects in the photos you provide.

• AI results are indicative and may not be fully accurate. Always review detected objects before saving.
• Images are transmitted to OpenAI for processing. Submitted content is not used for model training by default.
• Do not submit images containing sensitive personal data of third parties without their consent.
• Do not use AI features to process content that violates applicable laws or these Terms.

9. Service Availability

We make reasonable efforts to keep Captory available and functional. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, third-party outages, or events beyond our control.

We are not liable for losses caused by service interruptions or unavailability.

Captory™ and the Captory logo are trademarks of Captory App. All rights reserved.

The Captory name, logo, design, source code, and all related content and materials are the exclusive intellectual property of Captory App and are protected by applicable copyright, trademark, and other intellectual property laws.

You may not use the Captory name, logo, or any confusingly similar mark in connection with any product or service without our prior written consent. You may not copy, modify, distribute, sell, or create derivative works based on our materials without prior written permission.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of AI results, or uninterrupted availability.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Captory App shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, lost profits, or business interruption, arising from the use of or inability to use the Service.

13. Termination

You may stop using Captory and delete your account at any time. We may suspend or terminate your access to the Service if you breach these Terms or as required by law. Upon termination, provisions that by their nature should survive (intellectual property, disclaimer of warranties, limitation of liability) will remain in effect.

14. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you by reasonable means within the app or by email. Continued use of the Service after the changes take effect constitutes your acceptance of the new Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Chile, and any dispute shall be submitted to its competent courts. If you reside outside Chile, the mandatory consumer protection and personal data protection rules of your country of residence that cannot be waived by contract will continue to apply in your favor.
