Terms of Use

1. Eligibility

You must be at least 13 years old to use Captory. By using the Service, you confirm that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

Captory is an intelligent inventory application that lets you create, organize, and manage inventories of physical objects using photos, AI detection (InstaScan), barcode scanning, voice notes, and manual entry.

The Service is offered in a free tier and paid subscription plans. We reserve the right to modify, add, or remove features at any time with reasonable notice.

3. User Account

You are responsible for maintaining the confidentiality of your credentials.

Do not share your account with others or allow unauthorized access.

You must provide accurate and up-to-date information when registering.

You are responsible for all activity that occurs under your account.

You may delete your account at any time from Settings › Delete account.

4. Acceptable Use

You agree not to:

Use the Service for any illegal or unauthorized purpose.

Upload content that infringes third-party intellectual property rights.

Attempt to access, probe, or compromise our systems without authorization.

Resell, sublicense, or redistribute the Service or any part of it.

Use automated tools (bots, scrapers) to extract data from the Service.

Upload content that is harmful, abusive, defamatory, or obscene.

Impersonate another person or entity.

5. Content Responsibility, Prohibited Conduct & Indemnification

You are solely responsible for all content you upload, capture, process, or store in Captory, and you represent and warrant that you hold all rights necessary to use it. You agree not to use the Service to create, upload, store, or process content that: (a) is illegal or promotes illegal activities; (b) infringes the intellectual property, privacy, or other rights of third parties; or (c) violates the usage policies of our providers, including OpenAI, Apple, and Google.

You are strictly prohibited from using the Service to produce, upload, store, distribute, or process child sexual abuse material (CSAM) or any content that sexualizes minors. Any such content will be reported immediately to the National Center for Missing & Exploited Children (NCMEC) and/or the competent authorities, and records will be preserved as required by law.

We may immediately suspend or delete, without notice or refund, any account that violates these rules. You further agree to indemnify and hold harmless Juan Pablo Meza (Captory), its officers, employees, and providers from any claim, damage, loss, or expense (including reasonable legal fees) arising from content you upload or from your use of the Service in violation of these Terms.

6. Subscriptions and Payments

Captory offers the following plans: Free, Express Moving, Personal Pro, Properties, and Captory Business. Paid subscriptions are billed periodically according to the plan selected.

Payments are processed by Apple App Store, Google Play, or RevenueCat depending on your platform.

Subscriptions renew automatically unless cancelled before the renewal date.

To cancel, manage your subscription from your App Store or Google Play account settings.

Refunds are subject to the refund policy of Apple or Google, as applicable.

We reserve the right to change prices with prior notice. Existing subscriptions are not affected until renewal.

Downgrading or cancelling a plan takes effect at the end of the current billing period.

7. Your Content

You retain ownership of all content you create in Captory — inventories, photos, notes, and data. By using the Service, you grant Juan Pablo Meza (Captory) a limited, non-exclusive license to store, process, and display your content solely to provide and improve the Service.

We do not sell your content to third parties. Your content is processed by our infrastructure and AI providers strictly to deliver the features you use. See our Privacy Policy for full details.

8. AI Features (InstaScan)

InstaScan uses OpenAI's vision models to detect and describe objects in photos you provide.

AI results are best-effort and may not be fully accurate. Always review detected objects before saving.

Images are transmitted to OpenAI for processing. Content sent is not used for model training by default.

Do not submit images containing sensitive personal data of third parties without their consent.

Do not use AI features to process content that violates applicable laws or these Terms.

9. Service Availability

We make reasonable efforts to keep Captory available and functional. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, third-party outages, or events beyond our control.

We are not liable for losses caused by service interruptions or outages.

Captory™ and the Captory logo are trademarks of Juan Pablo Meza (Captory). All rights reserved.

The Captory name, logo, design, source code, and all related content and materials are the exclusive intellectual property of Juan Pablo Meza (Captory) and are protected by applicable copyright, trademark, and other intellectual property laws.

You may not use the Captory name, logo, or any confusingly similar mark in connection with any product or service without our prior written consent. You may not copy, modify, distribute, sell, or create derivative works based on our materials without prior written permission.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of AI results, or uninterrupted availability.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Juan Pablo Meza (Captory) shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption arising from your use of or inability to use the Service.

13. Termination

You may stop using the Service and delete your account at any time from Settings › Delete account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or pose a risk to the Service or other users. In serious cases, termination may occur without prior notice.

14. Changes to These Terms

We may update these Terms periodically. Significant changes will be communicated within the app or by email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by Chilean law without depriving you of mandatory protections in your country of residence. Except for disputes validly subject to arbitration under section 16, jurisdiction lies with the courts competent under applicable law. This choice of law does not limit non-waivable consumer rights.

16. Individual Arbitration and Class Action Waiver

IMPORTANT NOTICE: this section may affect your right to go to court, to a jury trial, and to participate in class actions. It applies mutually to you and Juan Pablo Meza, an individual in Chile operating Captory only if you reside in the United States, have reached the age of majority under applicable law, applicable law permits it, and you expressly accept this section after receiving this notice. Continued use or signing in alone does not constitute acceptance. It does not cover disputes that arose before that acceptance.

Individual arbitration. Subject to the exceptions below, disputes arising from Captory or these Terms will be resolved through binding arbitration before a neutral arbitrator administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules and, where applicable, its mass arbitration rules (https://www.adr.org/rules-forms-and-fees/consumer/). The United States Federal Arbitration Act governs this arbitration agreement. The arbitrator may award the same individual remedies as a court and will issue a reasoned written decision.

Procedure and costs. You may participate remotely or, if an in-person hearing is appropriate, in your county of residence in the United States unless you subsequently agree otherwise. Fees will be allocated under AAA consumer rules and applicable law; Captory will pay the fees those rules or the law assign to it. Nothing requires you to pay costs that prevent you from exercising your rights. If AAA cannot administer the case, a substitute administrator requires both parties’ written agreement; without agreement, you may proceed in a competent court.

Mutual class action waiver. To the extent permitted by law and only for disputes covered by this validly accepted agreement, you and Captory agree to bring claims in your own names, without acting as a plaintiff or class member in a class or representative action. The arbitrator may not adjudicate class claims. This provision does not prevent coordinated individual claims or application of AAA mass arbitration administrative rules.

Exceptions and preserved rights. Either party may bring an eligible individual claim in small claims court. Reports to authorities, non-waivable rights and remedies, judicial interim relief permitted by law, and requests for public injunctive relief that cannot lawfully be excluded remain available. A competent court will decide the formation, validity, and enforceability of this agreement and the class waiver. If the waiver is unenforceable for a claim, that claim will proceed in a competent court and will not become class arbitration.

Opt-out. You may reject this entire section without losing access to Captory by emailing [email protected] within 30 calendar days after your express acceptance, with the subject “Arbitration opt-out”, your name, and your account email. No explanation is required. If you opt out, neither the arbitration requirement nor the class waiver in this section applies. You may also use Settings > Arbitration and rights > Opt out of arbitration within the same period.

Outside the United States. This section does not impose mandatory arbitration or a class action waiver on residents of other countries. In Chile, consumers retain the right to go to a competent court and, if an arbitrator is designated under a valid subsequent agreement, to challenge that arbitrator without stating a reason as provided by law. Compulsory consumer arbitration is not imposed in Brazil. Any subsequent voluntary arbitration requires a valid agreement under applicable law.

Changes and acceptance. Future changes to this section require renewed express acceptance to apply and will not affect disputes that have already arisen. General terms acceptance or sign-in records do not replace specific acceptance of this section. Nothing in this section exempts Captory from legal liability.
